Dear Dr Ozdowski

Thank you for your letter of 13 December 2004 inviting the Ministry to contribute to the discussion about discrimination in employment on the basis of criminal record.

While the Ministry has direct responsibility under the Passenger Transport Act 1990 to attest that certain persons are suitable for carrying out public passenger services, no employer/employee relationship exists between the Ministry and such persons.

The Ministry follows all necessary steps to ensure compliance with all relevant legislation in exercising its obligations under the Passenger Transport Act, and a statement setting out this procedure is attached.

The Ministry supports the Commission's intention to prepare and publish guidelines that aim at preventing discrimination in employment, and would also be pleased to receive advice as to any appropriate training that assessment officers should have in this regard.
